DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — As restaurant owners continue to complain that COVID decimated sales and claim that restaurants are safe, the Florida Department of Business and Professional Regulation continues to conduct inspections that reveal potentially serious health and safety issues.

Burt and Max’s in West Delray Beach was cited for seven “high priority violations” and two “intermediate” violations during an inspection on April 13th. They include a finding of “black/green mold-like substance in the interior of the ice machine,” and “live, small flying insects in kitchen.”

The restaurant was also cited for multiple “time and temperature” issues involving food.

High Priority – Time/temperature control for safety food cooked/heated yesterday/on a previous day not cooled from 135 degrees Fahrenheit to 41 degrees Fahrenheit within a total of 6 hours. Food has been cooling overnight. Gumbo soup 50 in the center 45 around the edges, prepared on 04/12 based on date marked on the lable, baked diced potatoes 46 in the center 43 around the edges, baked on Sunday 04/11 as per chef, **Repeat Violation** **Admin Complaint**

High Priority – Time/temperature control for safety food hot held at less than 135 degrees Fahrenheit or above. Wings 116, chicken breast in water 127, baked eggplant 76,grilled onions 63, cooked potato 79 as per chef all less than 2 hours. Explained time as public health control and he completed the form . High Priority – Time/temperature control for safety food not cooled from ambient temperature to 41 degrees Fahrenheit within four hours. See stop sale. Portioned butter 51 f on trays at 1:05. As per chef was portioned at 10 am today, ambient cooling 3 hours 5 minutes.Chopped lettuce tomato mix 57 at 1:10 pm as per chef chopped at 10 :30 am today. Ambient cooling 2 hours 40 minutes in refrigerated railing. all at expeditor station.Soup mo.1 158, soup no. 2 159 at expeditor station. Second temperature of portioned butter 66 at 3:05 pm, chopped lettuce and tomato mix 55 at 3:10 pm, **Repeat Violation** **Admin Complaint**

Portioned butter 51 f on trays at 1:05. As per chef was portioned at 10 am today, ambient cooling 3 hours 5 minutes.Chopped lettuce tomato mix 57 at 1:10 pm as per chef chopped at 10 :30 am today. Intermediate – Accumulation of black/green mold-like substance in the interior of the ice machine. **Warning**

Intermediate – Handwash sink not accessible for employee use due to items stored in the sink. Soiled stainless steel milk container stored in hand sink by express machine. Manager removed **Corrected On-Site** **Repeat Violation** **Warning**

An inspector returned the following day and noted that all violations, except for one “basic” violation, were cleared. The restaurant was not ordered closed at any time during the process. Neighboring — but completely unrelated — restaurant Ocean One Bar and Grille was shut by the State of Florida earlier in the month for mass violations.
